What Class 42 protects

  • Software as a service (SaaS) and cloud platforms
  • Custom software and application development
  • Hosting, infrastructure and cloud storage
  • Information technology consulting
  • Industrial design and technical research

What Class 42 does NOT protect

These look similar but belong to another class. Choosing wrong is the most common reason a trademark protects less than its owner believes.

  • Downloadable software and installable applicationsGoes in Class 9
  • Marketplaces, advertising and retail servicesGoes in Class 35
  • Data transmission as a telecommunications serviceClass 38: Telecommunications
  • Educational or entertainment contentGoes in Class 41

The most expensive mistake in Class 42

If your product is a subscription to a cloud platform, class 42 is the primary class, not class 9. Many Mexican startups register class 9 only, because they think software rather than service, and end up with a trademark protecting a downloadable product they do not actually sell. When the business has both faces, platform and app, both classes get registered.

Classes commonly filed alongside Class 42

In Mexico each class is a separate application. Which classes you need depends on what your business actually does and how you plan to enter the market, not on the classes being related to each other. These show up in similar businesses, but the right list comes from your own activity.

Not sure which class you need?

A wrongly chosen class cannot be fixed later: you refile and you pay again. We review your case and tell you exactly which classes your trademark belongs in before anything is filed.
