What Class 35 does NOT protect

The most expensive mistake in Class 35
Class 35 is the most requested and the most misunderstood. It does not protect you selling your own product: the product's own class already covers that. It protects the retail or intermediation service you provide in respect of goods, yours or other people's. An online store, a marketplace or a franchise does belong here. A factory that simply sells what it makes does not. Filing in class 35 with a generic description along the lines of general retail services is one of the most frequent causes of an office action from IMPI.
