Slogan Registration in Mexico: Protect Your Tagline Before IMPI

If your business uses an advertising phrase that people associate with you, that phrase can be registered in Mexico. Mexican law calls it an aviso comercial (commercial slogan), and it is the form of protection IMPI grants to slogans.

Almost nobody searches for it by that name. People look for “how to register a slogan in Mexico”, find out the procedure is called something else, and stop there. This page answers both questions: what it is, and what it costs.

What a commercial slogan is, under Mexican law

The Federal Law for the Protection of Industrial Property defines it this way (our translation):

A commercial slogan is any phrase or sentence intended to announce to the public commercial, industrial or service establishments or businesses, products or services, in order to distinguish them from others of the same kind or class in the market.

Article 201, LFPPI

The exclusive right to use it is obtained by registering it with IMPI, not by using it (Article 200).

That is the practical difference from a trade name, which is protected without registration under Article 206. Your slogan is not: if you do not register it, you have no exclusive right over it in Mexico.

What you need to know before filing

It is a phrase, not a logo

A commercial slogan protects phrases or sentences. If what you want to protect is a name, a logo or a design, that is a trademark and it follows a different route.

You must specify what it advertises

If the slogan advertises products or services, the application must specify them (Article 202). Filing the phrase on its own is not enough.

Ten years, renewable

The registration lasts ten years from the date it is granted and can be renewed for equal periods (Article 204). That is the same term as a trademark.

Trademark rules apply

Where there is no specific provision, the rules the law sets for trademarks apply to commercial slogans (Article 205). That includes examination, oppositions and grounds for refusal.

Official IMPI fees

Figures from the IMPI tariff (Acuerdo por el que se da a conocer la Tarifa del IMPI), published in the Diario Oficial de la Federación. The tariff column is the amount the tariff sets; the next column adds the 16% VAT, which is what is actually paid.

A commercial slogan costs the same as a trademark. Article 14 a of the tariff covers, under the same fee, the application to register “a trademark, commercial slogan or trade name”.

And the 10% online discount applies. Provision NOVENA grants the discount on the services under Article 14 a, which is where the commercial slogan falls. Filing through IMPI’s Marca en Línea system saves MXN $312.64 including VAT.

The process, step by step

    Clearance search

    Before paying for the application we check whether the phrase is already registered or conflicts with an existing trademark.

    Define what the slogan advertises

    If the slogan advertises products or services, they must be specified in the application. This decision sets the scope of your protection and it is where most mistakes happen.

    Filing with IMPI

    Preferably through Marca en Línea, which applies the 10% discount under provision NOVENA.

    Examination and publication

    IMPI examines the application and publishes it. During that period a third party can oppose it, just as with trademarks.

    Grant of registration

    Once the registration is granted, the ten-year term starts running from the grant date.

Can I register my slogan as a trademark instead of a commercial slogan? They are different forms of protection and the law keeps them separate. What if I just use it without registering? Article 200 is explicit: the exclusive right is obtained through registration. Without registration there is no exclusivity over the phrase.
